These Terms and Conditions (“Terms”) govern access to and use of www.aurapep.ca and purchases from AURAPEP. By using the website, creating an account, or submitting an order, you agree to these Terms and the policies incorporated by reference. If you do not agree, do not use the website or submit an order.

Nothing in these Terms limits a right or remedy that cannot legally be limited or excluded under applicable law.

AURAPEP does not maintain a public business telephone number. Customers may contact AURAPEP through the Contact page.

2. Age and research-use requirements

AURAPEP products are offered exclusively as laboratory and research materials. They are not for human consumption and are not offered for medical, diagnostic, therapeutic, veterinary, household, food, cosmetic, or recreational use.

Sales are available to individuals aged 19 or older who satisfy these Terms and intend a lawful research use. A purchaser is not required to represent a business or institution.

By purchasing or possessing an AURAPEP product, you represent that:

  • you are at least 19 years old;
  • you are legally permitted and suitably qualified to purchase, receive, store, handle, and use the product for a lawful research purpose;
  • you will review product information, labelling, safety information, and available documentation before use;
  • you will provide appropriate facilities, equipment, training, supervision, storage, handling, disposal, and risk controls;
  • you will not use, administer, distribute, resell, relabel, or promote the product for human or animal consumption or for an unlawful purpose; and
  • you are responsible for determining whether the product and intended activity are lawful in your jurisdiction.

AURAPEP may decline, hold, or cancel an order where eligibility, intended use, payment, identity, address, fraud, safety, legal, or compliance concerns arise.

3. Product information and availability

We make reasonable efforts to present product names, strengths, formats, prices, images, descriptions, stock status, and available documentation accurately. Images may be illustrative, and packaging or presentation may change where the identity and specifications of the ordered product are not materially affected.

Product and batch documentation availability varies. A Certificate of Analysis or other document is available only where expressly associated with the relevant product or batch. Website content and research documentation are informational and are not medical or professional advice.

All products are subject to availability. Adding a product to a cart does not reserve stock. We may impose quantity limits, correct errors, or cancel an unavailable or incorrectly listed item. If an affected order has been paid, we will provide an appropriate refund as required by law.

4. Prices, currency, and taxes

All website prices are displayed in Canadian dollars unless stated otherwise. Before an order is submitted, checkout displays the itemized product price, shipping charge, applicable taxes, discounts, and total amount payable.

AURAPEP currently does not collect sales tax at checkout based on its present registration and tax configuration. This may change if legal or registration obligations change. Customers remain responsible for taxes, duties, fees, or obligations that apply to them and are not required to be collected by AURAPEP.

If a price, product, shipping, or checkout error is discovered, we may contact you for instructions or cancel the affected order. We will not charge or retain more than the correctly disclosed and accepted amount without your agreement.

5. Orders and contract formation

Before submitting an order, you can review the selected products, quantities, delivery information, shipping charge, payment terms, and total, and correct errors. Clicking the final order button submits an offer to purchase under these Terms.

An automated acknowledgement confirms that we received the order; it does not necessarily mean the order has been accepted for fulfilment. AURAPEP may review payment, inventory, intended use, address, fraud, legal, and other order information before acceptance. The order is accepted when AURAPEP confirms payment and begins processing, unless applicable law provides otherwise.

The order confirmation and related transactional emails form part of the distance-sales contract and should be retained. Customers are responsible for providing complete and accurate contact, billing, shipping, and order information.

6. Interac e-Transfer payment

The initial AURAPEP payment method is Interac e-Transfer. After submitting an order:

  • send the full order total to the e-Transfer address shown in the checkout and order instructions;
  • include the AURAPEP order number in the transfer message; and
  • complete the transfer within 24 hours after the order is submitted.

Orders remain on hold while payment awaits confirmation. If complete payment is not received and matched within 24 hours, AURAPEP may cancel the order and release its inventory. The customer may submit a new order later, subject to current price, stock, shipping, and other terms.

Do not send online-banking passwords, security credentials, or unrelated sensitive information. Bank or transfer fees charged to the sender are the customer’s responsibility. A transfer is confirmed only when funds are received, verified, and matched with the order.

7. Canadian shipping

AURAPEP currently ships within Canada only. We do not presently offer local pickup or international shipping.

  • Orders below $299.00 qualify for Canadian flat-rate shipping of $19.99.
  • Orders of $299.00 or more qualify for free Canadian shipping.

The qualifying threshold is calculated using the merchandise subtotal after discounts and before shipping unless checkout clearly states otherwise. The shipping charge and final total displayed and accepted at checkout control for that order.

Orders are prepared after payment confirmation and order review. Available delivery details, destination, shipping method, and estimated timing are shown through checkout, the order confirmation, or shipment communication where available. Delivery dates are estimates unless expressly guaranteed in writing.

Customers must provide a complete and deliverable Canadian address. Contact AURAPEP promptly if a correction is required. Address changes cannot be guaranteed once processing or fulfilment has begun. Title and risk of loss pass only as permitted by applicable law.

8. Cancellations, returns, and refunds

The AURAPEP Returns & Refunds Policy and Shipping & Delivery Policy are incorporated into these Terms. Contact AURAPEP before returning any product.

Cancellation cannot be guaranteed after an order enters processing or fulfilment. Return eligibility depends on the circumstances and product condition. Opened, used, tampered-with, compromised, temperature-exposed, or otherwise unsuitable research products should not be assumed eligible for return or resale.

Damaged, incorrect, missing, delayed, or delivery-related issues should be reported promptly with the order number, a description, and photographs where applicable. A refund or replacement is determined after review and is not automatic except where required by law.

Approved refunds for Interac e-Transfer orders will be arranged using an appropriate agreed method after necessary identity and payment verification. These policies do not limit cancellation, refund, or other rights under applicable law.

9. Accounts and security

You may browse the catalogue and submit an order using the account or guest options available at checkout. You must provide accurate information and keep account details current.

You are responsible for protecting your username, password, email account, and devices, and for activity performed through your account unless applicable law provides otherwise. Notify the AURAPEP Contact page promptly if you suspect unauthorized access. We may suspend or restrict an account where reasonably necessary to protect customers, AURAPEP, the website, or legal and security interests.

10. Acceptable website use

You must not use the website or products for an unlawful, unsafe, fraudulent, deceptive, or unauthorized purpose; interfere with website operation or security; introduce malicious code or bypass access controls; misrepresent identity, qualifications, intended use, payment, delivery, or order information; commercially exploit content without authorization; or use AURAPEP materials to imply an affiliation, endorsement, medical claim, or authorization that does not exist.

11. Intellectual property

The website and its original text, design, graphics, branding, product presentation, databases, and other content are owned by or licensed to AURAPEP and protected by applicable intellectual-property laws. Limited personal access does not transfer ownership or grant a commercial licence. Third-party trademarks and content remain the property of their respective owners.

12. Disclaimers

To the maximum extent permitted by law, the website and informational content are provided on an “as available” basis. AURAPEP does not provide medical, diagnostic, therapeutic, veterinary, legal, or regulatory advice. No website statement should be interpreted as recommending human or animal use. Researchers are responsible for independent assessment, lawful protocols, appropriate facilities and controls, and interpretation of research information.

Any express product commitment stated in the accepted order or applicable law continues to apply. Nothing in these Terms excludes a statutory condition, warranty, representation, right, or remedy that cannot legally be excluded.

13. Limitation of liability

To the maximum extent permitted by law, AURAPEP will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss arising from website use, unauthorized or prohibited product use, improper storage or handling, third-party services, or events beyond AURAPEP’s reasonable control.

Where liability cannot be excluded but may lawfully be limited, AURAPEP’s aggregate liability relating to a product or order will not exceed the amount paid for the product or order giving rise to the claim. These limitations do not apply where prohibited by law. Consumer rights and remedies remain unaffected.

14. Indemnity

To the extent permitted by law, you agree to indemnify AURAPEP against third-party claims, losses, and reasonable costs arising from your unlawful website use, material breach of these Terms, or unauthorized, prohibited, or unlawful handling, use, distribution, relabelling, or resale of products. This does not apply to the extent a claim results from AURAPEP’s conduct or where prohibited by law.

15. Third-party services and links

The website may rely on or link to third-party services, including email, payment, hosting, postal, courier, and documentation services. Third-party services are governed by their own terms and privacy practices. AURAPEP is not responsible for a third-party service it does not control, subject to obligations applicable law places on AURAPEP.

16. Privacy

The AURAPEP Privacy Policy explains how personal information is collected, used, disclosed, retained, and safeguarded and is incorporated into these Terms.

17. Events beyond reasonable control

AURAPEP is not responsible for delay or failure caused by events beyond its reasonable control, including carrier disruption, severe weather, natural disaster, fire, labour disruption, utility or network outage, cyber incident, governmental action, supply interruption, public-health event, or similar circumstance. This does not limit rights that cannot legally be limited.

18. Governing law and disputes

These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable there, without excluding mandatory consumer protections that apply in another jurisdiction.

Before starting formal proceedings, contact the AURAPEP Contact page with the relevant order information and a description of the issue so the parties can attempt resolution. Nothing prevents either party from seeking urgent relief or using a process available by law.

19. Changes to these Terms

We may update these Terms for future website use and orders. The “Last updated” date identifies the current version. The Terms accepted when an order is submitted will govern that order unless the parties agree otherwise or applicable law requires a different result.

20. General provisions

If a provision is held invalid or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue to apply. A failure to enforce a provision is not a waiver. These Terms, the accepted order, and incorporated policies form the agreement relating to website use and the order, subject to information and rights required by law.
